Terms and conditions for subscription

The website (hereinafter referred to as "OZERTY") is published at the address https://ozerty-norge.com.
ARTICLE 1: Definitions
To facilitate the readability of these Subscription Terms, the following terms will always have the meaning and scope assigned to them in this article.

| Login details | Refers to the username and password chosen by the User and which allow them to access their User Account in order to access all or part of the service. |
| Service | Refers to the service offered on the website by OZERTY for the conclusion of one or more subscriptions via the website. |
| Website | Refers to the website https://ozerty-norge.com. |
| User | Refers to any adult natural person or legal person registered on the website and subscribing to the service, if applicable. |
| Subscriber | Refers to any user who has subscribed to the service. |
| OZERTY Wallet / Store credit | A commercial benefit with no monetary value, credited to the Subscriber's account and usable as a discount on eligible purchases. |
| Billing cycle | The recurring 28-day period for which the subscription is billed (a rolling cycle, which does not correspond to the calendar month). |
| Ozerty VIP | Refers to the subscription program offered by Ozerty. |
ARTICLE 2: Acceptance of the terms
These terms govern Users' access to the subscription service offered on the website (Ozerty VIP). Subscribing to the service constitutes acceptance of these terms and conditions.
The subscription is completed at checkout by adding the VIPWELCOME5 offer to your order via the "Apply offer" button. This offer gives you a 5% discount on your order, a credit of 60 kr towards a future order, and activates your VIP subscription. By adding this offer and confirming your payment, you acknowledge that you have read, understood and accepted these terms.
The current version of the terms is available at any time and freely accessible on the website. OZERTY may change the terms at any time depending on certain technical, economic, legal or commercial constraints, such as the launch of new services.
Users are informed of changes to the terms within a reasonable time. In such cases, they must accept the new applicable terms in order to continue to benefit from the services. If not, the User may terminate the subscription as described in Article 6; orders placed before the change are maintained on their original terms.
Any deviations from the terms, to be valid and binding on OZERTY, must be the subject of a written document signed by OZERTY and the User and expressly referring to the terms.
OZERTY reserves the right to suspend any subscription or immediately terminate its services in favour of a User, in particular if they violate a provision of the terms.
A printed version of the terms as well as any information sent electronically will be accepted in any legal proceedings concerning the application of these terms, in the same manner and under the same conditions as any other document kept in paper format.
The fact that OZERTY does not exercise a right recognized by these terms may under no circumstances be interpreted as a waiver of the right to exercise that right in the future.
In case of non-acceptance of the terms, the User must refrain from taking advantage of the subscription service on the website.
ARTICLE 3: Description of the VIP Program
By subscribing to Ozerty VIP, the Subscriber agrees to pay 375 kr per 28-day billing cycle. In return, the Subscriber receives:
- upon subscription, via the VIPWELCOME5 offer: a 5% immediate discount on the subscription order and a welcome credit of 60 kr, usable on any order of 275 kr or more and valid for as long as the subscription is active;
- a recurring credit of 500 kr credited to the OZERTY Wallet for each billing cycle paid, usable on any order of 275 kr or more;
- access to member-exclusive promotions, priority customer service, and other benefits that may be introduced.
Store credit is granted as a commercial benefit; it is personal, has no monetary value and cannot be converted into cash or refunded. It applies only to the price of eligible products and does not cover shipping or other services. The cycle credit is granted after each successful payment and accumulates on the account. Unused credits are retained for as long as the subscription remains active. The minimum order to use a credit is 275 kr.
Important: the benefits are only available for as long as your subscription is active. In the event of termination, or of termination for non-payment, all unused credits are immediately and permanently lost.
ARTICLE 4: Free trial period
Every new Subscriber receives a 28-day free trial period upon their first subscription, with access to all VIP benefits, including the welcome credit and the cycle credit.
If the Subscriber terminates during the trial period, the benefits cease immediately and no amount is charged.
At the end of the 28 days, and unless termination is requested before that deadline, the subscription becomes payable, and your payment method is charged 375 kr. A reminder email is sent to you before this first charge.
ARTICLE 5: Payment
The subscription is 375 kr per 28-day cycle, charged automatically every cycle from the end of the trial period. The cycle is 28 days and does not correspond to the calendar month. By subscribing, you authorize OZERTY to charge the applicable fees to the payment method used at the time of subscription, every cycle, unless the subscription is terminated or a renewal is skipped.
In the event of an unsuccessful charge, OZERTY automatically retries up to 3 times over a period of 14 days; if the payment still fails, the account is suspended and then terminated, and unused credits are lost.
ARTICLE 6: Termination
The subscription is a non-binding service and can be terminated at any time. You can terminate online from your account portal (via the "My account" button at the top of the website, or directly at https://secure.ozerty-norge.com/portal), or by email to kontakt@ozerty-norge.com. Online termination takes effect immediately; email requests are confirmed within 2 business days. Upon termination, access to all VIP benefits ceases, and all unused store credits are immediately and permanently lost.
ARTICLE 7: Skipping a renewal
You may choose to skip an upcoming renewal, thereby avoiding the charge of 375 kr and forgoing the corresponding credit of 500 kr for that cycle.
You can access your account portal via the "My account" button at the top of the website, or directly at https://secure.ozerty-norge.com/portal. It is from here that you can skip a renewal and terminate your subscription.
7.1 Deadline. The request must be submitted at least 7 days before the next charge date. Within the 7 days preceding the charge, the option remains visible on your account but can no longer be applied to the imminent cycle; it will then apply to the following cycle.
7.2 How to do it. You can skip a renewal from your online account, or by email to kontakt@ozerty-norge.com. A confirmation is sent once the request has been processed.
7.3 Several consecutive skipped renewals. You may skip several consecutive renewals, with no annual limit. Skipping a renewal does not terminate your subscription: it resumes automatically at the next cycle that is not skipped.
ARTICLE 8: Right of withdrawal
In accordance with the applicable consumer legislation, you have a period of 14 days from subscription to exercise your right of withdrawal, by means of an unambiguous statement addressed to kontakt@ozerty-norge.com. During the trial period, no amount is charged: you may terminate at any time free of charge. If you withdraw after a first charge and have not used any store credit, the amount charged is refunded within 14 days to the original payment method. Store credits already used, as well as discounts already applied to an order, remain acquired and do not give rise to a refund.
ARTICLE 9: Refund policy
Beyond the statutory right of withdrawal in Article 8, and as a commercial gesture, OZERTY may grant the refund described below.
As a general rule, subscription fees are not refundable once a cycle has been billed. If, however, you terminate without having used any VIP benefit (no discount and no store credit applied to an order) during the period concerned, you may request a refund of the corresponding payments made within the last 120 days.
Any benefit used, even partially, makes the cycle in which it was granted non-refundable. Likewise, credits already used may under no circumstances be refunded.
To request a refund, contact kontakt@ozerty-norge.com within 30 days of your termination and confirm that no benefit has been used during the periods concerned. Approved refunds are processed within no more than 14 business days to the original payment method.
If you believe a charge has been made in error, contact our customer service at kontakt@ozerty-norge.com within 7 days of the transaction date.
ARTICLE 10: Changes to the terms
OZERTY reserves the right to edit these conditions at any time. Any substantial change is notified at least 30 days before it takes effect. If the Subscriber does not accept the new terms, the Subscriber may terminate the subscription following the procedure above.
ARTICLE 11: Limitations of liability
The service is provided "as is" and "as available" without any warranty of any kind. OZERTY cannot be held responsible for the unavailability of a product, or if the product purchased does not meet the Subscriber's expectations. This clause does not affect the mandatory rights you have as a consumer under applicable law.
ARTICLE 12: Personal data
By subscribing to Ozerty VIP, the Subscriber agrees to OZERTY's use of personal data in accordance with the privacy policy on the website.
ARTICLE 13: Applicable law and dispute resolution
These terms are governed by Norwegian law. Any complaints must be sent to kontakt@ozerty-norge.com. In the event of a dispute, the parties shall first endeavour to find an amicable solution. Failing an amicable agreement, the consumer may turn to an alternative consumer dispute resolution body. The list of approved bodies is available via the European Commission at https://consumer-redress.ec.europa.eu/dispute-resolution-bodies. The consumer retains the right to bring the matter before the competent Norwegian courts.
